Article 1: Background

You use the online sales service of Alpaderm SARL (hereinafter referred to as “Seller” or “Alpaderm”), a Swiss company based in Ardon, registered in the Swiss commercial register under license number CH-626.4.009.486-4.

These General Terms and Conditions of Sale are systematically displayed to each buyer (hereinafter referred to as “Buyer”) before continuing the process of ordering products on the Alpaderm website.

The Customer, before placing an order, declares to be bound in full legal capacity to the General Conditions of Sale.

Any access, subsequent use or order of one or more products on the Alpaderm website implies the express and total acceptance by the Customer, without reservation, of the content of the General Terms and Conditions of Sale, which prevails over all other documents, such as, but not limited to, brochures and catalogues transmitted by the Seller, which are for informational purposes only. The acceptance of these general conditions of sale will have the same legal value and the same effect as the written signature of the buyer.

By ordering products via this site, you confirm that you fully and unreservedly accept the general conditions of sale.

The seller is therefore not obliged to take into account any contradictory conditions reported by the buyer, unless expressly accepted by the seller, regardless of when said contradictory conditions are brought to his attention.

Article 3: Quality guarantee

ECOCERT certified products that meet COSMEBIO standards are indicated by an asteristic on our www.alpaderm.com website.

Article 4: Price

All prices are inclusive of VAT in Swiss francs (CHF) in Switzerland and in euros (€) for the rest of the world.

Alpaderm reserves the right to review its prices at any time, it being understood that the prices invoiced are those in force on the date of validation of the order.

Processing and shipping costs are additional and are indicated before any order confirmation. They are offered from 60 CHF or 50 €.

Our special product offers are valid within the limits of the period of validity of the offer and stock availability.[/vc_column_text][vc_column_text]

Article 5: Customs duties for countries outside Switzerland or France

Certain local taxes and/or customs duties may also be levied upon delivery of a package. All additional taxes and duties are the responsibility of the Buyer. Alpaderm is not responsible for informing the Customer of these additional costs.

Article 6: Order and transaction confirmation

When placing an order, it is important to include your phone number, mailing address and email address. When you validate the order, you confirm that you fully and unreservedly accept the order and these General Terms and Conditions of Sale in their entirety. Your order is then transferred to our customer service for processing.

We reserve the right to refuse customer orders in the event of a payment dispute with a previous order.

Once your order is received, a detailed order confirmation will be sent to the email address you provide. This order confirmation will include the exact invoice amount and delivery details of the order. This order confirmation indicates our acceptance of your order and validates the transaction. You agree that our order taking system constitutes proof of the nature and date of the order.

Article 7: Availability of products

In case of unavailability of a product after placing an order although initially mentioned as being in stock, the Customer will be informed as soon as possible by e-mail to refund it or replace it with a similar product.[/vc_column_text][vc_column_text]

Article 8: Secure payment

Payment for your order is made via the payment method authorized for the product offer in question. Online payment by credit/debit card is completely secure. The entire transaction is carried out using encryption technology via a Swiss bank validation server in SSL (Secure Socket Layer) mode. Alpaderm never has access to your payment data. This system ensures that your purchases are completely secure.

8.1 Accepted payment methods

Payment must be made in full, using a credit card (Visa, American Express, Mastercard) or PayPal. Credit cards are charged on the day the order is placed and payment is considered effective from the day the transaction is authorized by the buyer’s bank.

The Customer guarantees Alpaderm that he has the necessary authorization to use the payment method chosen on his order form.

As part of the fight against Internet fraud, information relating to an order may be transferred to a third party for verification purposes.[/vc_column_text][vc_column_text]

Article 9: Cancellation in case of non-payment

For orders placed outside our website, in the event that the buyer does not pay for the goods within the payment period, the seller has the right to cancel the sales contract, request the return of said goods and demand the payment of punitive damages to cover the loss of income and other additional costs caused by non-payment.

With regard to the period prior to cancellation, all sums remaining unpaid on their scheduled due date will result, in accordance with the law, in a moratorium penalty of 5% on the due date, without prior notification. The buyer must reimburse all collection costs.[/vc_column_text][vc_column_text]

Article 10: Delivery and shipping costs

10.1. Generally

The products will be delivered to the delivery address indicated on the Buyer’s order form: accurate information is therefore necessary to ensure efficient transport. All items purchased on www.alpaderm.com are bound by a shipping contract. This means that the risk of loss and title to these items passes to you upon delivery to the carrier. The Buyer is responsible for checking the condition of the package and its contents upon delivery to the delivery person.

If the parcel has been deposited directly in the mailbox and is damaged, the Customer must go to his post office and bring an action for damages without opening the package.

10.2. Costs and delivery times

The shipping costs depend on the amount of the order, the weight of the package and the place of delivery.

The exact delivery prices are indicated before the validation of the order.

Orders are processed within 2 working days. The delivery time is that defined by the Swiss or French post depending on the country of destination.

Alpaderm declines all responsibility in case of late delivery, loss of product, strike, fire (non-exhaustive list).

10.3. Features of Colissimo delivery

The products are delivered to the address indicated by the Buyer on the order form. An acknowledgment of receipt will be signed by the Buyer. In case of absence, the Buyer receives a notice of passage from the delivery person which allows him to collect the products ordered at the nearest post office up to fifteen days.

In the event that the parcel is not claimed from the Post Office within the time limit and subsequently returned to Alpaderm, the parcel may be redirected against prior payment of the corresponding shipping costs.

In case of return by post with the mention “not known at this address”, and if the products are in perfect condition for resale, Alpaderm will refund the Customer by refund by credit card the total amount of the order less the total delivery costs. Alpaderm does not refund duties and taxes. The buyer can then place another order using the correct address.[/vc_column_text][vc_column_text]

Article 11: Consumer guarantee

The seller guarantees that the goods are manufactured, checked and packaged without any physical defects.

This warranty does not cover defects that the buyer may discover during the examination of said goods.

If product defects are revealed after delivery, the buyer will request in writing the application of the product warranty. This request must include the invoice number and the reason for the request for replacement of the product(s) in question.

The products sold on www.alpaderm.com comply with the regulations in force in Switzerland and France. Alpaderm cannot be held liable in the event of non-compliance with the legislation of the country in which the products are delivered, which the Customer must check.

Article 12: Disclaimer of Warranty and Limitation of Liability

www.alpaderm.com is provided by Alpaderm on an “As is” and “As available” basis.

In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this website and all constituent parts, trademarks, designs, models, logos, visuals, etc. on this website and their compilation are exclusively the property of Alpaderm or its suppliers; The latter do not grant any license or any other right to Internet users than to consult this site.

The reproduction or use of all or part of these components is only authorized for information purposes and for personal and private use; Any reproduction or use of copies made for other purposes is expressly prohibited. Article 15: Applicable law

This contract is subject to Swiss law. The United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (Vienna Convention) is explicitly not applicable. The language used for this contract is French. The Swiss court is the only body competent to deal with disputes.
